  • Dist. 16 Congressional race gets heated

The campaign for El Paso's District 16 congressional seat, while unclear where the boundaries are, is heating up.

During Sunday's Superbowl game, this ad aired http://vimeo.com/36162566 featuring Congressman Reyes driving around El Paso showing off projects that the helped get funding.

In response to the ad, former El Paso city council member and now Democratic congressional candidate, Beto O’Rouke, released a statement disputing a number of the claims made in Silvestre Reye's ad.

A portion of those disputes, as well as rebuttals, are listed below.

O'Rourke argues that a number of the claims in Reyes' ad are not the actual work of the congressman himself, rather money that would have come to El Paso anyway.

A spokesperson for Reyes said from broader legislation like the American Recovery Act of 2009 to individual earmarks, "The Congressman's responsible for, and to shape legislation that is valuable for El Paso."

    Levees:

O’Rourke statement: “$220 million was appropriated to the U.S. International Boundary and Water Commission on February 17, 2009 as part of the Recovery Act. Only $27.2 million of those funds are being spent in Congressional District 16. This allocation was long overdue: breached levees in Storm 2006 were the result of deferred maintenance. The $220 million was allocated for the whole region along the Rio Grande, not just in El Paso as Congressman Reyes would have you believe. (http://www.ibwc.gov/Files/CF_URG_FCP_Updates_121310.pdf, see slide 3)”

Reyes statement: Congressman Reyes has supported legislation to help secure $220 million to help rebuild the levees.

Congressman Reyes worked closely with the then Democratic House leadership to guarantee that IBWC received $220 million through the American Recovery and Reinvestment Act of 2009 for the rehabilitation of approximately 170 miles of levees along the Texas-Mexico border.  The American Recovery and Reinvestment Act was championed and supported by Congressman Silvestre Reyes and Democratic Leadership in the face of unanimous Republican opposition.  With this funding, IBWC will be able to rehabilitate most deficient levees in just two to three year instead of 20 years at previous funding levels.

O’Rouke Statement: The Camino Real Regional Mobility Authority (RMA) deserves the credit for financing the local share and for applying for the competitive stimulus funds. Without the RMA, we’d have no eastside spaghetti bowl. Congressman Reyes opposed the creation of the RMA, but he was delighted to attend the ribbon cutting and take the credit. (http://archives.newspapertree.com/transportation/reyes_rma_letter.pdf)

Reyes statement: Congressman Reyes has supported legislation to help secure millions for the new Eastside spaghetti bowl.

Nearly 75 percent of the Eastside Spaghetti bowl was funded using federal dollars, a large portion of the funds were made possible by the passage of the American Recovery and Reinvestment Act- legislation championed and supported by Congressman Silvestre Reyes and Democratic Leadership in the face of unanimous Republican opposition.

In comparison, approximately $30 million in local funds were provided by the City of El Paso.  TxDOT estimates that 185 jobs were created.

This is the largest construction project in El Paso funded by the American Recovery and Reinvestment Act (ARRA).  The interchange will have four ramps connecting Loop 375 to I-10, and will significantly improve traffic flow and relieve congestion in East El Paso.

    Plaza Theatre:

O’Rourke Statement: Reyes claims: “Paisano Green Community. Over $8 Million,” and “Sun Metro Bus Transit. Over $125 Million,” and “Plaza Theatre. Over $1.2 Million.”

Most of these federal dollars that Reyes claims as his victory are the result of agencies competing with other communities for grants. They are not earmarks, directed by Reyes’ influence. For example, the Paisano Green community fund came as a result of the Housing Authority applying for the Capital Funds Recovery Competition with a $500,000 pledged loan from the City of El Paso. HACEP was awarded that grant based on merit, not their congressman’s influence. (See press released titled: “HACEP Receives $8.25 Million in Competitive Stimulus Funds for Green Communities: http://www.elpasotexas.gov/mayor/_documents/nl_2009_11/HACEP%20Receives%208%2025%20Million%20From%20Stimulus%20For%20Green%20Communities.pdf and http://www.elpasotexas.gov/muni_clerk/agenda/07-28-09/07280910B.pdf)

You have only to search congressional earmarks to see that the Congressman directed precious few dollars to these important community initiatives. (http://www.legistorm.com/earmarks.html)

Reyes statement: Congressman Reyes has requested direct appropriations  to help secure over $1.2 million in critical funding for the renovation of the Plaza Theatre.

    FY04 Interior Appropriations Bill

$200,000 - El Paso Plaza Theatre Renovation

FY04 VA, HUD, Independent Agencies Bill

$150,000- El Paso Plaza Theatre Renovation

FY03 VA, HUD, Independent Agencies Bill

$900,000- El Paso Plaza Theatre Renovation

O’Rourke statement:  According to Govtrack.us, Silvestre Reyes missed 805 (8%) of 10,344 roll call votes since Jan 7, 1997.  That means he only voted 9,539 times. It also means that Reyes has one of the worst voting and attendance records in Congress, with 95% of Congress coming to work more often than he does. (http://www.govtrack.us/data/us/112/repstats/novote.xml, http://www.govtrack.us/congress/person.xpd?id=400337&tab=votes)

In his 16 years in congress, he has only sponsored and passed six bills and two of those successful bills were to rename federal buildings. (http://www.govtrack.us/congress/billsearch.xpd?sponsor=400337)

Reyes statement:  Congressman Reyes has taken over 10,000 votes on legislation on the floor of the House, the Armed Services, Veteran Affairs, and Intelligence Committees.  He has a 92% lifetime voting record and has used his seniority both to directly request and support legislation that has brought billions in resources for El Paso.  He has directly authored and requested language in over 70 appropriations bills alone and that language has become law.

Mr. O’Rourke uses a web source that does not include information on the hundreds of votes Congressman Reyes has taken in committee.   Appropriation bills carry the name of the Chair of the committee as the lead sponsor and it is not necessary for a bill to have a Congressman’s name to impact their district.  Mr. O’Rourke doesn’t understand that process.  While it may important for Mr. O’Rourke that bills have his name on it, what matters to Congressman Reyes is that El Paso related legislation be included in any legislative vehicle.  At the end of the day, El Paso is what matters, not whose name is on the bill.

  • Immigrants rights group battles Gov. Martinez over drivers license law for illegals

Immigration rights or public safety -- that's the question at the center of the controversy surrounding New Mexico Gov. Susana Martinez's efforts to end a law allowing undocumented immigrants to drive.

Las Cruces residents Angelica and Albert Leno worry that repealing the law would leave their family unable to get by because Angelica is the only driver and she is undocumented.

Angelica Leno drives to work where she cleans homes, drives to pick up their son from school because there is not an available bus and drives her husband to the doctor.

Albert Leno is wheelchair-bound and is unable to drive.

"I don't have a driver's license because I'm physically handicapped and my wife drives me around," Albert Leno said.

Gov. Susana Martinez is trying for a third time to repeal a law allowing undocumented immigrants to drive legally in the state.

"The desire of New Mexicans is clear and it's time to vote to repeal the law," Martinez said during her State of the State Address in January.

Martinez told KFOX14 that she plans to keep trying to repeal the law as long as she has to -- but hopes this time will be the last.

"People will come up to me constantly and say don't give up," Martinez said. "Don't stop fighting for the repeal of that law."

Immigrant rights groups like the Border Network for Human Rights, to which the Lenos belong, have been fighting back against the governor's efforts the whole way and like the governor, they said they don't plan to back down on the issue.

"I feel like the governor has done a very good public relations job to convince people there's some sort of problem, systemic problem," BNHR Policy Director Jose Manuel Escobedo said.

New Mexico is one of only two states that currently allows undocumented immigrants to receive a government issued driver's license.

Martinez said that the problem with the law has always been about safety and nothing else.

"It's a public safety issue, not an immigration issue," Martinez said.

Albert Leno said that repealing the law would leave more drivers on the road without insurance and without valid drivers licenses.

"Why try to fix something that's not broken?" Albert Leno said.

Immigrant rights groups said that Martinez's actions are hypocritical because her own grandparents were Mexican immigrants.

"My grandfather came here with permission with the Department of Labor to come to work," Martinez said. "So, I don't see that as hypocrisy. He followed the rules and following the rules is all we're asking people to do."

  • Las Cruces City Council Votes to Support Jemez-Anthony casino project

The Las Cruces City Council tried to resurrect plans to build a new casino in Anthony through a resolution during Monday's City Council meeting.

All but one City Council member voted 'yes' to support the Jemez-Anthony casino project.

Councilor Greg Smith voted against the resolution, expressing concern over respect for tribal community laws and possible safety risks.

Plans to build the casino were stopped last year because of a technicality. The federal government rejected the Jemez Pueblo's proposal because the location was considered too far from tribal land.

Mayor Ken Miyagishima said that the city was hoping to be able to give the project new life through the resolution.

"We don't want the issue to just be completely dropped," Miyagishima said.

Miyagishima said that the City Council felt that it wasn't given the time it was supposed to have during the application process to express its support for the plan.

"We don't believe we were given that time and they went and just closed the application process and didn't really allow us to give them our input," Miyagishima said.

The proposed casino would sit in Anthony off the freeway, encompassing around 100 acres of land. It's expected to bring in 950 permanent jobs to the area and 570 construction jobs.

Anthony residents like Irma Ayalla said that she hopes the casino is built because it will boost the area's economy.

"It's good for Anthony because it's going to bring a lot of jobs," Ayalla said. "The restaurants will have more business because there will be more people."

The project was first proposed in 2004 and a lot of locals felt it was all but dead after last year's federal rejection.

Miyagishima said that he hopes the project will now be seriously considered again because of the council's resolution.

"We feel that it's necessary to keep it on the forefront," Miyagishima said.

  • Witnesses: Man pushed wife so hard he almost fell with her

KFOX14 obtained the arrest affidavit of a man who is accused of pushing his wife off Interstate 10.

The day after neighbors of the couple told KFOX14 it's something they never thought possible.

Andres Galvan lives feet from 35-year-old Gutemberg Najar and 31-year-old Rocio Herrera.

"A good pair of neighbors, but I've never seen any problems with that family, would never hear nothing," said Galvan.

Galvan said she did hear the news of a man pushing his wife off of Interstate 10 Sunday.

"I didn't know it was that family," said Galvan.

Galvan's eyebrows rose when KFOX 14 broke the news to him.

"I've never seen any fights, between anybody," he said.

El Paso police said a fight just before 2 a.m. Sunday sent Najer's wife, Herrera, to the hospital.

According to the arrest affidavit witnesses called police when they saw Najer dragging Herrera back to their Jeep they said was parked in the right-hand emergency lane of I-10 east near Airway Boulevard.

Witnesses told police they then saw Herrera run from Najer straight to the guardrail where they said she put one leg over.

Another witness told police they saw Najer trying to pick up his wife and drag her to the car after the fall. In doing so, the arrest affidavit stated that he kept dropping her head on the pavement, causing her head to hit the asphalt. This happened about 20 times, stated the witness.

A day later, a pool of blood still marks where Herrera fell. Witnesses said Najer pushed his wife so hard he almost made the 15-foot drop to Gateway East with her. When police found the couple, Herrera was slumped over, unconscious in the Jeep. The affidavit states Najer was standing over her with blood stains on the front of his shirt.

"They keep to themselves most of the time," said Galvan.

KFOX 14 stopped by the couple's Lower Valley home Monday afternoon. Najar has since bonded out after being jailed, but no one answered the door.

Najar isn't a stranger to a jail cell or assault. A search of his record shows last September, Najar was given nine months probation and 120 hours of community service after being charged with assault on a family member in December 2010, something Galvan said he never expected.

"It was always 'Hi', hi, how are you,'" he said.

Police could not give an update on Herrera's condition, but according to the affidavit at last check she was unconscious with a 4- to 5-inch laceration to the top of her skull.

  • Sun Metro bus hits woman in downtown El Paso

An elderly woman is recovering at University Medical Center after a Sun Metro bus hit her while she was crossing the street in downtown El Paso Monday afternoon.

Police said the woman, who is in her seventies, was crossing northbound at Texas Avenue when the bus was making a left turn from Stanton Street. Special Traffic Investigators said they believe the woman had the right of way, crossing on a walk signal.

With about eight people on board the bus and many people on the sidewalk, there were many witnesses to the accident.

"I just heard the break of the tires, and people yelling and running for the bus," said Rachel Rojas, who was bringing lunch to her boyfriend at work. "She was stuck under the bus in front of the tires. It was heartbreaking. You could tell she was in a lot of pain."

Rescue crews were able to pull the woman out from under the bus without lifting the vehicle off the ground, and rushed her to UMC with critical injuries.

"With the high level of pedestrian traffic downtown, around schools, or different places where you see it, it's very important to be congnisant and keep and extra eye out for pedestrians," said Sergeant Chris Mears with the El Paso Police Department.

Rojas, who said she's also had close calls with Sun Metro busses in the area, echoed Mears's warning.

"This is downtown," Rojas said. "This is where elderly ladies come to do their shopping, just slow down."

Sun Metro spokewoman Laura Cruz- Acosta said the driver of the bus will not be driving while the investigation continues. Instead, the driver will be assigned to duties in the Sun Metro office.

Earlier Monday morning, another Sun Metro bus was involved in a vehicle crash.

The bus driver was not at fault; a car that tried cutting off the bus at Mesa Street and Yandell Drive was hit by the bus when it made an unsafe lane change.

Two passengers on board of that bus were taken to the hospital for minor injuries.

  • CBP investigating Henderson Middle School bus incident

Officials with a federal agency, whose employee may have pulled over a school bus last week, said they can't comment on this case.

Parents of the boys' basketball team at Henderson Middle School were outraged when they learned that a man claiming to be a Customs and Border Protection officer boarded the bus and cussed out the students.

According to parents, the man flashed a badge at the bus driver on Thursday and forced him to pull over when an object was thrown out the school bus window.

Parents told El Paso Independent School District officials about the incident, demanding answers.

At this time CBP officials said, "We're investigating this case and do not tolerate actions that would tarnish the reputation of our agency."

  • Driver in vehicle crash with bus cited

Police and paramedics were at the scene of a crash that involved a Sun Metro bus Monday morning.

The accident happened at Mesa Street and Yandell Drive in downtown El Paso around 10:40 a.m.

According to police, a bus and a red vehicle were driving westbound on Yandell Drive when the driver of the red vehicle sped up to cut off the bus driver at the Mesa intersection.

In result of the unsafe lane change police said the bus struck the car as it made a left turn.

Two passengers on the bus were taken to the hospital for minor injuries.

The driver of the red vehicle was cited for unsafe lane change.

  • Family of woman shot, killed speak exclusively to KFOX14 News

Sisters of a woman who was fatally shot early Monday spoke exclusively to KFOX14.

“There was no history (of violence) at all," said a woman who would only identify herself as the younger sister of 43-year-old Hilda Gonzalez. “That's why it's so shocking to our family to come to find out that this happened."

Leo Martinez, 23, is Gonzalez’s son. He was arrested and charged with murder in connection with Gonzalez’s death.

He has been booked into the El Paso County Detention Facility under a $600,000 bond.

The sisters did not want to talk about Martinez, or circumstances that may have led to the shooting. They only wanted to dispel any myths that the shooting was drug-related.

The shooting happened about midnight on Monday in the 1500 block of Cactus Wren Place, just outside of Horizon City.

  • Club Patrons: Bouncer fractured my friend's face

Two women said a bouncer at popular downtown night club fractured their friend's face in an early morning incident.

Just after 1:30 a.m. Sunday, the two women, Ana Gonzalez and Jasmine Mitra, said they, along with their friend, Fernando, were attempting work with their server at The Plum after being overcharged for drinks. The two said a bouncer came up to the trio, and asked them to leave.

"The bouncer he came, and he seemed really nice at first, and were like, okay fine, we're leaving, and all of the sudden, I just see him grabbing my friend from the neck," Gonzalez said.

Gonzalez and Mitra said they went up to the bouncer and told him excessive force was not necessary, and attempted to pull Fernando away from the situation.

"That's when they just pushed me down, and they pushed [Fernando] down, five stairs down," Mitra said. She said her fall down the stairs caused her phone cover to break.

KFOX14 went to the owner of The Plum, and he had a very different account of what happened Sunday morning.

He said he was present at the time of the incident, and the alleged violence never happened. He said, he ordered the bouncer to throw the trio out after an incident, but wouldn't explain exactly what that incident was.

He said bouncers are not supposed to hit patrons, but said that is not what happened in this case.

The owner said this bouncer will continue to remain employed with the club.

  • Famly says crash victim may have been shot

A 31-year-old man was found dead inside his car after a crash and his family told KFOX14 that they suspect he may have been shot before he crashed.

Krystal Paiz said that her brother-in-law was the man found dead inside his car at the intersection of May Avenue and Martinez Street around 10:30 p.m. on Saturday.

Witnesses said that the victim drove into a parked car along Martinez Street before crashing into a fence.

Paiz said that the victim was the father of a four-year-old boy.

Paiz said that several family members tried calling him after he was supposed to get of work at the Suburbia Smokeshop, which is up the block from the crash scene, but he didn't answer their calls.

"It's so tragic," Paiz said. "He always answers and he didn't answer and he was supposed to pick up my mother-in-law. He never made it."

Paiz said that the family believes her brother-in-law could have been the target of a robbery.

"That store where he worked, it was robbed not too long ago," Paiz said.

Paiz said that they think her brother-in-law may have been shot and tried to escape driving down Martinez Street before he lost consciousness and eventually succombed to his injuries.

Las Cruces police said that there were reports of nearby gunshots but have not confirmed whether the gunfire is connected to the crash -- though police said it's a possibility.

'He was everything," Paiz said. "He was everything to the family. He was truly the heart of the family."

Police are not releasing the name of the victim because of an on-going investigation.

  • El Paso County to discuss burn ban

Monday morning, El Paso County Commissioners are set to "discuss and take appropriate action" to issue a new order banning outdoor burning in the unincorporated areas of El Paso County for 90 days.

According the county agenda, the topic is back up for discussion because of the continued threat of extreme wildfires.

The order was first issued by the Commissioners Court on April 18th, and reissued on July 11th  and October 31st.

As KFOX14 has reported, fire leaders said it can be extremely difficult to contain wildfires with windy conditions. Saturday, El Paso's Westside saw gusts of nearly 47 miles per hour, as crews battled and contained a small brush fire.

This item was submitted by County Judge Veronica Escobar. Commissioners' court begins Monday morning at 9:30 at City Hall.

  • Fire crews respond to Central El Paso house fire

An elderly woman and a young boy escaped with their lives from a house fire in central El Paso Sunday morning.

Fire crews responded to the home at 3208 Louisville around 9 a.m. Firefighters said heavy flames could be seen coming from one of the bedrooms.

Fire Department officials said a 77-year-old woman and a 6-year old boy were the only ones home at the time. Both were transported to University Medical Center as a safety precaution, but they did not have any injuries. Family members said they believed the boy accidentally set his mattress on fire.

"By the time the realized there was a fire, the house was pretty engulfed," said family member Gabriela Ontiveros. "We saw the smoke from our house down the street and came running when we realized where it was coming from. The only thing running through my head was 'call the other members of the family,'"

Ontiveros said The Red Cross put the family in a hotel for a few days, but that the inside of the house was destroyed by smoke damage. Fire investigators estimated the fire and smoked caused $90,000 in damage.

"We just ask that you keep our family in your prayers," Ontiveros said. "We lost a lot of stuff in the home."

Red Cross El Paso tweeted "A busy weekend for Disaster Services volunteers. Three house fires in the El Paso Area."  Saturday evening a fire broke out in east El Paso after an unattended candle burned a second story home at 1329 Rose Bud Lane. The family inside was able to escape after their smoke alarms went off, but fire investigators estimate $40,000 in damages to the home.

As a result, the El Paso Fire Department would like to remind the public to practice these fire prevention tips regarding candles:

    • Avoid using lighted candles.
    • If you do use candles, ensure they are in sturdy metal, glass, or ceramic holders, and placed where they cannot be easily knocked down.
    • Keep candles out of the reach of children and pets
    • Set a good example by using matches, lighters, and fire carefully.
    • Children should never be allowed to play with matches, lighters, or candles
    • Never leave the house with candles burning
    • Extinguish candles after use
    • Establish a fire-safe home, especially a safe sleeping environment
    • Never leave a candle burning unattended.

  • Mesilla mayor responds to racial profiling allegations

Mesilla mayor Nora Barraza is confident her police force is doing nothing illegal.

”I have spoken with him and he assures me racial profiling is not happening in the field,” said Barraza at a press conference on Friday night. She’s referring to allegations made against the Mesilla Marshalls office by LULAC’s immediate past state director, Paul Martinez.

Martinez sent Barraza a letter three weeks ago, asking her to look into allegations the marshalls are pulling over people for how they look.

Barraza said she only recently looked at the letter and is confident in her law enforcement team.

“Its one thing if they’re doing something illegal, but it's another to simply be pulled over for no reason,” said Martinez.

Marshall Jeff Gray said comments he made at a recent trustee meeting were taken out of context. In those meeting minutes, he’s quoted as saying “ we’re an extension of the border patrol,” referring to his department.

“Every law enforcement agency is an extension of other law enforcement agencies, but we only enforce state laws,” said Gray.

Martinez is hoping to sit down with Barraza and investigate these allegations.

  • Man charged with murder after stabbing

A man is charged with murder after a late-night stabbing leaves one man dead.

Officers arrived at the Lower Valley home, located on Maravilla Drive, just after 10 p.m., Friday. Authorities found Gerardo Juarez, the victim, with a stab wound to his upper body. Juarez was transported to Del Sol Medical Center, where he later died.

The investigation showed Ruben Canales and Juarez got into a verbal fight that quickly became physical. Police said  Canales grabbed a knife from the kitchen area of the home. As the two men struggled over the knife, Canales allegedly stabbed Juarez in the torso.

Canales was booked into the El Paso County Jail, with a bond set at $500,000.

KFOX14 spoke with a neighbor who lives right across the street from the home where the stabbing happened. He says the family had only been living there for about a month. He thinks the person stabbed was the father of the two girls who lived there. He also believes the suspect is the boyfriend of one of those daughters.

" I heard some sort of arguing, I heard someone slam the door, whoever it was, was trying to leave in the truck so I went inside and thought nothing of it," said neighbor Jose Alvarez.

Alvarez believes the family has already moved out as a result.

"It's sad, I've lived here for 25 years and nothing like this has ever happened, much less a stabbing," said Alvarez.

He realized it was something much more when detectives knocked on his door early in the morning to ask if he had seen anything.

This is the fourth murder this year, as compared to five at this same time in 2011.
